Information dispute of Right to Cultivate between FWI and Ministry of Agrarian Affairs and Spatial Planning/National Land Agency continues to Supreme Court

Public information dispute between Forest Watch Indonesia (FWI) and Ministry of Agrarian Affairs and Spatial Planning/National Land Agency has not finished until this time. At the trial on December 14, 2016, State Administrative Court stated that FWI won the objection submitted to the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency. Copy of Decision No. 2/G/KI/2016/PTUN-JKT dated December 23, 2016, are (pages 22 and 23):

1. Reject the Application for Objection Petitioner;
2. Strengthening the Decision of the Central Information Commission of the Republic of Indonesia 057 / XII / KIP-PS-M-A / 2015, dated July 22, 2016 (https://fwi.or.id/publikasi/putusan-sengketa-informasi-antara-fwi-dg-kementerian-atruangbpn/);
3. To punish the objection Petitioner for paying this case cost, which is as much as IDR 218,000, – (two hundred and eighteen thousand rupiah).

After receiving the State Administrative Court’s decision, dated December 29, 2016, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency submitted cassation. By this cassation, the Public Information Dispute will automatically proceed to the next judiciary – Supreme Court (Article 50 of Act No.14 of 2008 regarding the Public Information Disclosure).
